Holidays and how to calculate them correctly

20.08.2021
How many holidays are the employee entitled to?
The statutory holidays are 28 working days or 5.6 x for the number of days worked per week. Employees should be given the opportunity to take annual leave during the year in which it is accrued. The holidays year is 365 days or 366 days depending on whether the leap year is included (February 29).
Are bank holidays included in holidays?
An employer may include bank holidays as part of a statutory right.
From what date are holidays pay calculated?
When an employee starts work, the period of his holiday year can be determined in the corresponding agreement-contract. If the employee's holiday year is not specified in the agreement, then it simply begins on the first day of work. The employer must provide holidays pay during the statutory holidays.

Many people may have a question, if I am entitled to 22.2 days of holidays, then how much can I take 22 days or 23 days of holidays? In this case, the employer can round up the amount of holidays up, but cannot round it down, which means you can use 23 days.
Can the employer provide an employee with more paid holidays?
The employer can but is not obliged to provide more paid holidays - this will be in the employment contract and is called "the right to contract holidays."

For example:

Jack works 4 days a week, every day lasts 8 hours. His statutory holidays are 28 days or 5.6 x 4 days a week, which equals 22.4 days. So, Jack's holidays are 22.4 days.

But if the working day is 6 days a week, how many holidays are the employee entitled to in this case? In this case, the employee is entitled to only 28 days, because the statutory paid holidays are limited to 28 days.
How to calculate holidays for an employee if he has an irregular working day (for example, shift workers, working under a contract)?
They are entitled to paid time off for every hour they work. They might find it helpful to get an estimate of holiday entitlement by calculating leave based on days or hours worked in an average week.
Everyone should remember that paid annual leave is a legal right that an employer must grant to their employee.
